Cohabitation Revisted
Approximately 1996 or so, I spoke to the Lake County Bar Association Family Law Seminar on cohabitation. At that time, I had read and reviewed all the cases in Illinois since the IMDMA was passed in 1977 that dealt with cohabitation. The cases were all summarized in a chart with an accompanying article. The article and chart were published in the ISBA Family Law Section Council Newsletter. That is not available on line through the ISBA but the material is in the articles section of my web site.
How Do I Get The Records
You are involved in a contested custody case. You represent a parent. The child is seeing a therapist. The child is under age 12. You want to review the therapy notes and take the deposition of the therapist.

What is Necessary for the Power to Make A Decision?
In order for a Court to do anything, it needs two kinds of jurisdiction. "Subject Matter Jurisdiction" is the power of the Court to adjudicate. "Personal Jurisdiction" is the ability of the Court to exercise that power as to particular individuals.
Does it Matter if the Parents are Married?
The parent and child relationship, including support obligations, extends equally to every child and to the every parent, regardless of the marital status of the parents." 750 ILCS 45/3.

Jurisdiction is power. In order for a court to do something, it needs to have the power to do so. The court needs power over the subject matter.

When employers are served with a notice for withholding income on behalf of their employees, the notice requires them to withhold a specified amount of money for child or spousal support from an employee's income and send it to Illinois State Disbursement Unit.
